Black Carpet Rideshare & Logistics – Customer Disclaimer

By using the services of Black Carpet Rideshare & Logistics, you (“the Customer”) agree to the terms outlined in this Customer Disclaimer. This policy is meant to protect our drivers, customers, and the integrity of our service.

1. Identity Verification

To help maintain a safe and secure environment, all customers may be required to submit:

A clear profile photo

A valid national ID

A recent proof of address (utility bill, bank statement, etc.)

Failure to provide accurate and verifiable documents may result in restricted access or removal from our platform.

2. Fraud & Misuse Warning

You agree NOT to use your account or any Black Carpet Rideshare & Logistics to:

Arrange rides with the intent to harm, rob, or endanger a driver

Use false identities or impersonate someone else

Book rides or deliveries with fraudulent payment methods

Share your account with others without approval

Any attempt to commit fraud or endanger a driver will result in:

Immediate and permanent ban from our platform

Reporting to law enforcement with all relevant information

Legal action where applicable

3. Ride & Delivery Liability

You are responsible for ensuring accurate pickup and drop-off details.

We are not liable for missed pickups due to incorrect location info or failure to respond to driver calls/messages.

For delivery services, we are not responsible for loss or damage resulting from unclear instructions or miscommunication.

4. Payment Agreement

By using our services, you agree to:

Pay the full fare using either cash or an approved cashless method (PayWise, PayPal, EndCash, or WiPay/Colour)

Only use verified payment methods (e.g., WiPay/Colour card must be linked and physical)

Ensure payment is made before the completion of the trip/delivery

5. Communication and Safety

Black Carpet Rideshare & Logistics may contact you via WhatsApp or phone to confirm trips or verify your identity.

Harassment, threats, or unsafe behavior towards any driver or staff will result in permanent account suspension.

6. Service Limitations

We do our best to provide reliable service, but we are not responsible for:

Traffic delays or road closures

Delays caused by unforeseen incidents or emergencies

Availability of drivers in certain areas or at certain times

7. Acceptance

By booking a ride or using our delivery service, you acknowledge that you:

Have read, understood, and accepted this disclaimer

Understand that misuse of the service may lead to legal consequences.

Customer Terms of Use Agreement

This Agreement is made between Black Carpet Rideshare and Logistics, a Business duly incorporated and existing under the laws of Trinidad and Tobago (hereinafter referred to as ("The Business"), and the individual customer (hereinafter referred to as "the User").


1. PURPOSE AND RELATIONSHIP OF THE PARTIES

This Business provides a technology platform, accessible via the MyWebBooker site, that connects independent third-party drivers with Users seeking rideshare and logistics services ("Rideshare Services"). This Business does not provide transportation or logistics services.


The Rideshare Services are provided by the independent drivers, not the Business. By using the Platform, the User enters into a direct contractual relationship with the independent driver for each specific ride.


2. USER'S ACKNOWLEDGEMENT OF RISKS


2.1. ASSUMPTION OF RISK:


The User acknowledges and accepts that using Rideshare Services carries inherent risks, including but not limited to the risk of personal injury, property damage, robbery, or other harm. The User agrees that the Business is not responsible for and assumes no liability for any such risks.

2.2. INDEPENDENT DRIVERS:


The User understands that drivers are independent contractors and not employees or agents of the Business. This Business does not control the conduct of drivers or the operation of their vehicles.


2.3. NO GUARANTEE OF SAFETY OR SERVICE:


While the Business takes commercially reasonable efforts to vet drivers, it does not guarantee the safety, quality, suitability, or ability of any independent driver. The User agrees that the entire risk arising out of the use of Rideshare Services remains solely with the User.


2.4. VEHICLE INSURANCE:

The User acknowledges that while drivers are required to carry insurance, This Business does not provide insurance for the User, and the scope of a driver's personal insurance may be limited.


3. DISCLAIMER AND LIMITATION OF LIABILITY


3.1. "As Is" Service: The Business provides its Platform and Services "as is" and "as available," without any warranties, express or implied, regarding reliability, fitness for a particular purpose, or non-infringement.


3.2. THIRD-PARTY ACTIONS:

This Business is not liable for the actions, errors, or omissions of any third party, including independent drivers, other users, or any parties involved in a transaction initiated through the Platform.


3.3. MAXIMUM LIABILITY:

To the maximum extent permitted by law, the Business shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage, arising out of or in connection with the Rideshare Services.


3.4. THIRD-PARTY PLATFORM (MYWEBBOOKER):


The Business is not liable for any issues arising from the use of the MyWebBooker website, including but not limited to data breaches, site downtime, or other technical problems.


4. INDEMNIFICATION

The User agrees to indemnify, defend, and hold harmless the Business, its owners, and its affiliates from and against any and all liabilities, expenses (including legal fees), damages, and penalties arising out of or related to:


The User's use of the Rideshare Services.

Any breach by the User of this Agreement.

Any claim by a third party (including a driver) related to the User's use of the Platform.


5. PAYMENT OPTIONS


The Business offers the following payment methods:


Cash: The User may pay the Driver directly in cash at the end of the ride.

PayWise: The User may use the PayWise digital payment platform.


The User acknowledges that the Business has no liability for any issues arising from the payment process, including payment disputes between the User and the Driver.


6. USE OF MYWEBBOOKER


The User acknowledges that the Business uses the MyWebBooker website for posting and managing information. The User agrees that the Business is not responsible for the content, privacy policies, or practices of MyWebBooker.


7. ACCEPTANCE OF TERMS


By accessing or using the Black Carpet Rideshare and Logistics Platform, the User agrees to be bound by all the terms and conditions of this Agreement, which represents the entire understanding between the User and the Business.


ACKNOWLEDGMENT AND CONSENT


I have read, understand, and agree to the terms and conditions of this Agreement. I acknowledge that I am fully responsible for my use of the Rideshare Services and assume all risks and liabilities associated with it.
